Response to the case against 3 senior officers of Caerphilly Council being dismissed

Wayne David, Labour MP for Caerphilly, has responded to the news that a judge has dismissed the case against three senior officers of Caerphilly County Borough Council.

In March 2013 Anthony O’Sullivan, Chief Executive, was arrested by police and later charged. Nigel Barnett, Deputy Chief Executive, and Daniel Perkins, Head of Legal Services, were arrested in July 2013. The three officers were charged with misconduct in public office and after appearing before Bristol Magistrates’ Court they were sent for trial at Bristol Crown Court. After a number of delays, the case was adjourned until October and a trial date was set for November 2015. Today, the judge has dismissed the case.

 On hearing of the judge’s decision, Wayne David said, “I am appalled that it has taken so long for this decision to be arrived at. It is disgraceful that the Judiciary and the Crown Prosecution Service (CPS) has allowed this case to drag on for so long. It has been nearly 2½ years since the arrest of the officers and during this time Caerphilly County Borough Council and its residents have been obliged to spend millions of pounds.

 “I have previously raised this matter with the CPS and now I intend to raise it in Parliament and seek reimbursement from the Ministry of Justice of the millions which have been spent. It is outrageous that the failings of the CPS and the criminal justice system have cost a local authority so much money, especially at a time of public expenditure cutbacks.”
